1. Acceptance of Terms
By accessing and using Birchbury NZ ("Website", "We", "Us", "Our", "Birchbury Shoes" or "Birchbury.co.nz"), which is operated by Birchbury NZ Ltd, you agree to comply with and be bound by these Terms of Service. Please review these terms carefully. If you do not agree to these terms, you should not use this Website.
2. Description of Service
The Website offers barefoot and minimalist leather shoes, made with a wide toe box and a zero-drop sole so the foot can sit and move in its natural shape. There are no age restrictions for users of the Website.
3. Shipping
After receiving your order confirmation email, all orders are processed within 2 to 5 business days (excluding weekends and holidays). Note that the lead time to pick & pack an order is different from shipping time. You will receive another notification when your order has shipped. All orders are dispatched from Auckland, New Zealand.
We ship to New Zealand and Australia only. We do not offer local delivery or in-store pickup. We ship to PO Boxes.
Standard shipping is free on all New Zealand and Australian orders, with no minimum spend. Paid express and courier upgrades are available at checkout.
Customers in the United States should shop at birchbury.com, and customers in Canada at ca-birchbury.ca. 4. Orders, Pricing and Availability
Prices are shown in New Zealand dollars (NZD) for New Zealand customers and Australian dollars (AUD) for Australian customers. Your currency is set automatically from your delivery country. All prices include GST — 15% on New Zealand orders and 10% on Australian orders. Delivery charges, where they apply, are shown separately at checkout.
Any Order placed by You in the manner described in this website is an offer to purchase a particular Product for the price (including the delivery, other charges and taxes) specified in this Website at the time you place your order on these Terms & Conditions.
Birchbury NZ reserves the right to accept or reject your order for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order.
5. Returns and Exchanges
Returns and exchanges are accepted within 30 days of the original purchase date. To start one, email hello@birchbury.co.nz with your order number. Approval must be given before you send anything back.
Return postage is at your own cost, in both New Zealand and Australia, and the item must reach us before a refund is issued. The first exchange on an order is provided free of charge. For any subsequent exchange, a $25 fee will apply to cover shipping and restocking costs, and a photo of the product will be required to confirm it is in new, unworn condition. All returned items must be in their original condition and packaging, and refunds are processed after we receive and inspect them.
Faulty, damaged or incorrect items are always free to return, including postage, and no exchange fee applies to them. We reserve the right to decline future returns or limit service to customers who exhibit a pattern of excessive returns or abuse of our refund policy. Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or, for Australian customers, the Australian Consumer Law. 6. Privacy
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully. We do not sell your personal information, and we will not use your email address for unsolicited mail. How we collect, use, share and protect your information is set out in full in our Privacy policy.
7. Disclaimer of Warranties
The Website and its content are provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. This does not exclude or limit any guarantee, warranty or right that cannot be excluded or limited under the New Zealand Consumer Guarantees Act 1993 or the Australian Consumer Law.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the Website following the posting of any changes to the Terms constitutes acceptance of those changes.
